• Understanding Employment Contracts

    Typically when people talk about the "employment contract" what they are actually referring to is the physical document that contains the main terms - the "Main Document" or "Principle Statement".
     
    The Employment Contract - the legally binding agreement between employer and employee - is actually made up of expressed terms (written down) and implied terms (incorporated by statute, collective agreements etc).
     
    Many of the express terms must be supplied to the employee on the 1st day of employment as part of the main document. Some can be provided in a "Supplementary Statement" (written down elsewhere - so often in policies or letters)... and for many of these you have 2 months to provide to the new employee.
    Also...just because it's expressed doesn't necessarily make it part of the contract - employment law and statutory rights trump whatever you write down, and some terms are deemed unenforceable.
